Terms and Conditions of TestSeed

These Terms and Conditions ("Terms") govern the use of the TestSeed platform operated by Neo Maaßen, Schäfflerstr. 2e, 86424 Dinkelscherben, Germany ("we", "us", "TestSeed"). By creating an account or using our services, you agree to these Terms.
Our services are intended for users who are at least 18 years of age or have the consent of a legal guardian. By using TestSeed, you confirm that you meet this requirement.
Purpose: TestSeed provides a cloud-based platform for generating deterministic, synthetic test data ("seeds") via a web dashboard, REST API, and Node.js SDK.
Right of use: By generating data, you receive a worldwide, non-exclusive, perpetual, royalty-free right to use the generated data. You may freely use it in your own projects, applications, and databases, including for commercial purposes.
Platform ownership: All intellectual property rights in the TestSeed platform, including the software, UI, entity library, documentation, and branding, remain with TestSeed. These Terms do not grant you any rights to the platform itself beyond the limited right to access and use the service as described.
You agree not to:
We reserve the right to temporarily or permanently suspend accounts that violate these Terms or engage in abusive behavior, after giving reasonable notice where possible.
Processing: All payments are processed via the service provider Stripe, Inc. By subscribing, you also agree to Stripe's Terms of Service.
Prices: The prices displayed in the dashboard at the time of ordering apply. All prices are inclusive of VAT where applicable.
Billing cycle: Subscriptions renew automatically at the end of each billing period (monthly or annually, depending on your plan) unless canceled beforehand.
Cancellation: You may cancel your subscription at any time via the billing section in your dashboard. Cancellation takes effect at the end of the current billing period. You retain access to paid features until the period expires. No partial refunds are issued for the remaining billing period.
Free tier: The free plan does not require payment information and can be used indefinitely within the stated credit limits.
If you are a consumer within the European Union, you have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period expires 14 days after the day of the conclusion of the contract. To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement (e.g. an email to support@testseed.com).
Early expiry of the right of withdrawal: By completing your purchase and thereby requesting immediate access to the digital service, you expressly consent to the provision of digital content before the expiry of the withdrawal period. You acknowledge that you lose your right of withdrawal once the service is activated (i.e. when your paid plan becomes active and you can access paid features).
Consequences of withdrawal: If you withdraw, we will reimburse all payments received from you without undue delay and at the latest within 14 days from the day on which we receive notice of your withdrawal. We will use the same means of payment as you used for the initial transaction (Stripe refund).
By you: You may delete your account at any time via the account settings in your dashboard or by contacting us at support@testseed.com. Upon deletion, all your seeds, API keys, and associated data will be permanently and irreversibly deleted immediately. Billing records may be retained as required by law (e.g. tax retention obligations under German law).
By us: We may suspend or terminate your account with 14 days' written notice (email) if you materially breach these Terms. In cases of severe abuse (e.g. attempts to compromise infrastructure security), we may suspend access immediately and notify you afterwards.
Data availability: Once your account is deleted, all associated data is permanently removed and cannot be recovered. Please ensure you have saved any seed configurations or generated data you wish to keep before initiating account deletion.
Synthetic data: The generated data is purely synthetic and intended for testing purposes only. We accept no liability for the accuracy, completeness, or suitability of the data for use in production systems or safety-critical applications.
Availability: We strive to ensure high availability of the platform (hosted on Google Cloud), but do not guarantee uninterrupted or error-free service. Scheduled maintenance windows are announced in advance where possible.
Limitation of liability: In cases of slight negligence, TestSeed shall only be liable for breaches of material contractual obligations (Kardinalpflichten). In such cases, liability is limited to the foreseeable, typically occurring damage and capped at the total fees paid by you in the 12 months preceding the event giving rise to liability. This limitation does not apply to damages arising from injury to life, body, or health, or from intentional misconduct or gross negligence.

We may update these Terms from time to time. If we make material changes, we will notify you via email or a prominent notice in the dashboard at least 30 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your subscription and delete your account before the changes take effect.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers within the EU, mandatory consumer protection provisions of the country of your habitual residence apply in addition.
The place of jurisdiction for all disputes is, to the extent legally permissible, your place of residence. For business customers (B2B), the place of jurisdiction is Augsburg, Germany.
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
